The client appealed, but was turned down. As she was deemed fit enough to work, she rang the DWP to claim JSA, only to be told she could not claim it due to the fact that she would not be actively seeking work because there was no job she could do with her poor health. <\/p>\n\n\n\n<p>The claimant tried to claim ESA again but was turned down again because it was deemed that she had the same illness as before and therefore not allowed to reapply ESA within 6 months of a negative decision. She struggled without money to live on. We successfully challenged the ESA decision and a tribunal judge allowed the appeal.
